The principle of parliamentary sovereignty requires the courts to apply any legislation which has been properly passed. Even if that legislation clearly infringes international human rights obligations, the courts are powerless to intervene. They cannot set aside or quash statutes. Yet they play an important role in the protection of the ‘rule of law’ and human rights in the United Kingdom.
