ABSTRACT

The CBD’s ABS system is often and probably correctly seen as intending to bring benefits to developing countries as a matter of justice. The idea of pools 1 is linked to an understanding of a joint management of resources, which allows the objectives of justice to be pursued in this way. As the ABS system still has a number of deficiencies 2 , the idea of pools is itself a topic for further consideration (Winter 2009: 19–35). It might also be useful to consider whether the Nagoya Protocol supports such a concept.
