ABSTRACT

This chapter provides an overview of some of the key international standards and principles that are relevant to indigenous peoples and resource development, focusing in particular on the concepts of engagement, participation, consultation and consent – aspects that are directly related to indigenous peoples’ right to self-determination. It presents an overview of selected standards and instruments related to indigenous rights and public engagement in the context of resource development. Individual states encounter specific challenges in meeting their commitments, especially when it comes to balancing indigenous rights with industrial development imperatives. The chapter focuses on more depth at key terms employed in standards and instruments, including engagement, due diligence, consultation, participation, consent, and access to remedy and justice, with particular consideration of the relative responsibilities of governments and business. The chapter offers some concluding thoughts, reflecting on the relevance for Greenland.
