ABSTRACT

Human trafficking is one of the most severe forms of violence against human beings. Some of the literatures define it as the illegal transfer of a human being from one place to another for the purpose of trafficking, more specifically commercial exploitation. Trafficking of persons has flourished due to the patriarchal social structure, gender disparity, geographical inaccessibility, illiteracy and ignorance and exploitative socio-economic and cultural relation in the society. Nepal is mainly a source country for men, women and children subjected to forced labor and sex trafficking. Human Trafficking and Transportation Act, 2007, is the specific law to control the acts of human trafficking and transportation and to protect and rehabilitate the victims of such an act by enacting law. Victims can play a very prominent role in the prosecution process if they feel secure and protected.
