ABSTRACT

Nepal is a mountainous country rich with natural habitats and places along with culture, tradition and religious affairs. Today Nepal stands with unique cultural phenomena and diversity in the international arena. However, among these cultural practices, there are some practices folded with blind beliefs and superstitions followed in society which violate the range of basic human rights of an individual. Nepalis bound by international human rights law, as it is a party to the United Nations Charter and seven of the nine core international human rights treaties currently in force. Since time immemorial, the Chhaupadi tradition has been practiced in mid-western and far-western parts of Nepal. This practice has been deeply rooted in the social and cultural tradition in society. “No harm no culture” means that Chhaupadi can never be taken as a culture. The grotesque condition one lives in when experiencing the menstruation cycle can only be justified in the in realm of injustice.
