ABSTRACT

This chapter discusses the issues of criminal justice system by evaluating the provisions of the constitution and other relevant statutes relating to the functions of the said main agencies in Sri Lanka. It focuses on the rights guaranteed by the constitution of Sri Lanka and procedural laws relating to controlling the actions of the law enforcement agencies—the police—in order to protect the rights of the parties involved in a criminal matter, especially the suspect/accused. Since criminal law is part of the criminal justice system, one may correctly claim that there is a strong relationship between an effective criminal justice system and the concept of rule of law. Police officers are the gatekeepers of the criminal justice process. Prison is one of the important correctional institutions which are involved in the criminal justice process. Prison regulation 13 says that the Superintendent of the prison should ensure the daily needs of the inmates are provided adequately.
