ABSTRACT

This chapter lays out four categories of human rights which are threatened by the rapid expansion or lack of access to new technologies, leading to infringement of justice: (1) the right to freedom of speech and expression, the right against discrimination and the right to privacy; (2) the right to health and the right to protection of personal data; (3) the right to security and the right to information; and (4) the right to development and right to Internet access. The chapter refers to the judgments in the Shreya Singhal (2015) and Justice Puttaswamy (2017) cases in the context of the right to privacy and freedom of speech. It outlines the law regarding personal data protection in the European Union, as well as the Indian statutes, regulations and case laws relating to information, information technology and Aadhaar in the context of personal data privacy rights. The Justice B.N. Srikrishna Committee Report (2018) and the draft of the Protection of Personal Data Bill (2018) are also discussed.
