ABSTRACT

The Constitution of India guarantees social, economic and political justice, which are the basic features envisaged in the preamble. Justice is delivered through the judiciary, a co-equal branch of governance under the constitutional framework. Efficient and effective adjudicatory mechanism, speedy trial of cases, affordable and accessible court services and quality assurance are the key elements involved in delivering justice. The judiciary is overloaded with cases and thus backlogs keep mounting. The judiciary is concerned with various problems of which, the long pendency of cases is a glaring one. To address the problem, the Supreme Court has created the National Court Management System (NCMS). The objective of establishing a comprehensive court management system is to enhance the quality, responsiveness and timeliness of courts. In this chapter, an attempt has been made to show how the judiciary may move forward by inducing competitive advantage to render qualitative and timely justice. It also addresses certain problems persisting in the district judiciary and certain strategic interventions to gain public trust and confidence.
