ABSTRACT

The Construction (Design and Management) Regulations 2015 are the regulations for managing the health, safety and welfare of construction projects. It is a tragic statistic that, on average, there is close to one death per week on UK construction sites and many serious, life-changing injuries. Where a domestic client has appointed an architect or other designer they can, by written agreement, transfer the client duties to the architect/designer. Where no such agreement is made, the principal contractor automatically takes on the client's responsibilities. The client duties that are transferred relate to such matters as making suitable arrangements for managing the project, including making sure that the principal designer and principal contractor are appointed and that sufficient time and resources are allocated to the project. They also relate to making sure that relevant information is prepared and provided to other duty holders; that the principal designer and principal contractor carry out their duties; and that welfare facilities are provided.
