ABSTRACT

There is a gap between what philosophy can tell us about human agency and what the law would need to know about human agency in order to punish effectively. There is also a gap between what science can tell us about human agency and what the law would need to know about human agency in order to punish effectively. And, finally, there is a significant gap between what science tells us and what non-instrumental normative theory tells us, about pretty much anything, including human agency. This contribution to the collection describes the relationship among those gaps and suggests how we may still make progress.
