ABSTRACT

Through the lens of public defenders and the clients they serve, this chapter explores how our system of pre-trial detention supplants our adversarial system for adjudicating guilt and imposing punishment. It also illustrates how the supplanting of our adversarial system with one of pre-trial detention is not accidental and argues that the only effective reform is abolishing all pre-trial jailing.
