Configuring the rule of law in the EU polity
Supranational polities like the EU have challenged the concept of sovereignty in many ways. This chapter shows that the law and the rule of law have been a binder in the attempts to reconfigure sovereignty beyond the state. Put differently, in the European Union polity, the rule of law is located between supranationality and sovereignty in order to reconfigure power and authority between 27 sovereigns and a wide range of EU institutions and bodies. The chapter shows how the EU seeks to reconfigure the rule of law at the supranational level by rationalising its collaboration with the Council of Europe in the attempt to define standards and best practices to be achieved to safeguard domestically the rule of law.
