ABSTRACT

This chapter examines which avenues can be explored by states in order to reduce incentives for irregular migration, while at the same time preserving access to refugee protection, or even improving protection for the majority of the world’s refugees. It argues that if such ideas are ever to lead to concrete proposals, European Union Member States should carefully consider the legal parameters within which they will have to operate. The measures could even produce outcomes while still allowing for the maintenance of strict immigration controls. In the context of the Convention Plus initiative, the agency is contributing to the discussion on irregular secondary movements of refugees and asylum seekers. Fresh thinking about how to provide refugee protection in the 21st century, in the context of migration control strategies, is urgently needed.
