ABSTRACT

Within the Criminal Justice System there is a general perception that people with learning difficulties do not make reliable witnesses (Milne et al., 1996). In recent years there has been some attempt to examine particular problems associated with interviewing people with learning difficulties for investigative purposes. This research has uncovered a number of areas where problems may arise. In general, the majority of these problems relate to weaknesses in memory coupled with poor comprehension and communication that can lend themselves to an increase in levels of suggestibility. Research has found that people with learning difficulties have particular problems with certain forms of questioning.
