ABSTRACT

This chapter outlines many of the problems alluded to in Chapter 11. These include the difficulty in unequivocally stating whether statements are true or false, developing clear justifications for claims made about the nature of statements and the need to examine multiple aspects of a narrative account. The present case involves the defendant's controversial assertion that, subsequent to stealing and crashing a car (resulting in the death of a passenger) he retained no memory for the event. The report details the case study notes, the background literature on memory for accidents and the literature on malingering. Throughout, the author pays special attention to the need for further research in malingering and statement validation and highlights how current research is rather limited in helping form expert opinion.
