ABSTRACT
Seriously antisocial behaviour is one of the chief concerns of criminal law. This raises the question whether the problems of the risk society1 can be solved by ‘risk criminal law’ (Risikostrafrecht) and whether or not a new definition of the functions of criminal provisions is necessary. This is an important subject matter of criminal political discourse in Germany.
