ABSTRACT

Under the Hague Rules and the Amended Hague Rules, the time bar for taking action against the carrier is one year.83 However, the usual time limit applies if the carrier takes action against the shipper for freight.84 A classic example of this is the case of The Aries,85

where the carrier was able to claim successfully against the shipper for freight, and the shipper’s claims against the carrier was time-barred.
