ABSTRACT

This discussion will explore the relationship between land law and disability. In particular, it will demonstrate how this body of law can operate to create disability. Its aim is to raise awareness of the disabling effect of adherence to certain rules and policies. It is, of course, not only land law which is instrumental in the creation of disability. Every branch of law is likely to have its disabling aspects, though they may be subtle and generally unnoticed. Only if they are noticed can competing values and policies be weighed against each other and the law developed so as to promote inclusion and participation.
