ABSTRACT
ACAS has drawn up an arbitration scheme, the aim of which is that more claims should be settled by arbitration and fewer proceed to a tribunal hearing. The scheme will apply in the first instance to unfair dismissal and so will exclude discrimination claims. If both are alleged, the discrimination claim must be pursued separately. The arbiter may decide, if appropriate or convenient, to postpone the hearing pending the outcome of the employment tribunal proceedings.
