ABSTRACT
The European Commission can bring Member States before the ECJ for failure to implement EC legislation. The Commission can impose penalties against a Member State (Art 226 of the EC Treaty).
An action can also be brought by another Member State for failure to fulfil their obligations under the EC Treaty. The Commission has to be informed before the proceedings (Art 227).
