ABSTRACT

The case of Re Eve (1986) 31 DLR (4th) 1, decided in 1986, attracted considerable publicity, not least because it was cited as a leading overseas authority in the House of Lords’ case of Re B (the Jeanette case), which was being decided after the Eve decision had been handed down. The brief facts and outcome have been mentioned in Chapter 6, but we now take a more detailed look at this case.
