ABSTRACT

A feminist constitutionalism can be animated by a rethinking of sovereignty informed by a vision of inclusive community. This approach is neither an essentialism2 nor a separatism: it is, rather, an attempt to develop in public law a thinking already taking hold in other areas of legal scholarship;3 an elaboration of the work of the French scholar, Luce Irigaray.4 Although Irigaray has never written exclusively on sovereignty, her work has, at its
