ABSTRACT
If the judge wrongly fails to conduct a Newton hearing, the Court of Appeal will allow an appeal against sentence and will impose the sentence which would be appropriate on the basis that the defendant’s version of events is the correct one (R v Mohun (1993) 14 Cr App R(S) 5).
