ABSTRACT

Section 133(1) of the Magistrates’ Courts Act 1980 empowers a magistrates’ court to order that custodial sentences which it imposes may run concurrently or consecutively. However, the maximum aggregate sentence which may be imposed is six months (s 133(1)) unless the court is dealing with the offender for two or more offences which are triable either way; in that case, the maximum aggregate sentence is 12 months (s 133(2)).
