ABSTRACT
Generally, confusion between two businesses which are operating legitimately is not enough to constitute actionable damage. In Marengo v Daily Sketch and Daily Graphic Ltd (1947), Lord Greene MR referred to the fact that parties must put up with ‘the results of the confusion as one of the misfortunes which occur in life’ where the confusion arises from the collision of two independent rights or liberties.
