ABSTRACT

The other important contract formation issue to arise in the context of variation of long term relationships is that of sufficiency of consideration for the promise to vary. It has been observed already that there is a potential problem in these circumstances based on the possibility that the promisee will have done little more than he is already bound to do under the terms of the existing contract. Moreover, problems may also be encountered as a result of the rule that part-payment is not sufficient to discharge a debt.13
