ABSTRACT

Where the parties enter into a contractual relationship, it will not always be the case that the contract will be performed without mishap. It has been seen in the previous chapter that disputes may arise based on an alleged failure to perform the contract according to its terms, in which case, the court must interpret the express terms of the contract, or imply terms so as to make sense of the agreement the parties have reached.
