Although s 4 states that damage includes loss of life and personal injury, it is clear that property damage is also damage for the purposes of the defence and to the extent that economic loss is also a recoverable head of damage under the tort of negligence, it would be consistent to assume that this is also relevant damage for the purposes of the 1945 Act.
