The measure of damages under s 2(1) is designed to put the claimant in the position he would have been in if the statement had not been made.44 As such, this clearly involves the application of tortious principles of assessment and remoteness of loss. Moreover, the following extract also shows that the relevant tort rules to apply are not those employed in relation to a negligence action, but instead, those applicable to fraud actions.
