ABSTRACT

In relation to documents delivered at court by means of fax, the document is not filed until it is delivered by the court’s fax machine; the time of transmission from the party’s fax machine is not taken into account. If the document is delivered by fax after 4 pm, it will be treated as filed on the next day the court office is open. The party is not required to send a ‘hard’ copy by post or document exchange. Fax can be used to file such documents as statements of case, but should not be used to send letters or documents of a routine or non-urgent nature to court (PD 5 paras 5.3(1)–(6)), as there is a danger that they will not be placed before the judge in time for the matter to which they relate.
