ABSTRACT

The court prepares a notice (N55A) to the debtor and copy for the creditor which contains a date of hearing before the district judge. Notice of the application is sent to the debtor, together with a form of reply (N56), which the debtor is required to file within eight days of receipt. The summons is served as if it were a fixed date summons (Ord 7 r 10(5), Ord 27 rr 5(1), 17(3A)). The court officer may, at any stage, send an N338 (see above) to the debtor’s employers, if known (Ord 27 r 6).
