Pre-action behaviour in cases not covered by a pre-action protocol

In accordance with the overriding objective, the parties to all disputes will be expected to act reasonably in exchanging relevant information and documents and in generally trying to avoid the necessity for the start of proceedings, whether a case is covered by a pre-action protocol or not (PD – Protocols, para 4).
