ABSTRACT
If a party is held to have behaved unreasonably, the court may order them to pay costs to their opponent. The costs will be assessed summarily (r 27.14(2)(d)). It is rare for the judge to order that a party has behaved unreasonably, but an example might be where a party has unnecessarily caused a late adjournment of the hearing, unreasonably refused to negotiate, or failed to turn up at the hearing.
