The court also has a discretion to order one party to pay the costs of the other party’s expert fees up to a maximum of £200 (r 27.14(3)(d) and PD 27, para 7.3). The standard form of directions sent out by the court does not contain a note as to the limit on experts’ fees. If the maximum is exceeded, it may not be recoverable. Some courts are making this clear in their directions.

Although reference to these is made in r 27.14(4), there is no guidance as to what sums should be allowed.
