ABSTRACT

Directions, given at or without a hearing, will be tailored to the needs of the case and the steps already taken by the parties. The court will have regard to their compliance or non-compliance with any relevant pre-action protocol4 (PD 29, para 4.2). Its concern will be to ensure that the issues are identified and that the necessary evidence is prepared and disclosed (PD 29, para 4.3)

The court will expect the parties to co-operate in the giving of directions and may approve agreed directions which they submit (PD 29, para 4.6). See PD 29, paras 4.7 and 4.8 for guidance on the agreed directions which may be approved.
