ABSTRACT

As mentioned above, the main code for voluntary restrictions in relation to advertising in Ireland is the code published by ASAI. ASAI is a self-regulatory organisation which has three categories of membership, namely, advertising members, media members and agency members. The complaints committee of ASAI includes members nominated by the Director. The complaints committee may initiate corrective action and may issue appropriate directives. The self-regulatory system does not represent any curtailment of the freedom of commercial speech as enshrined in Art 10 of the European Convention on Human Rights, and it complements legislative control on advertising.
