ABSTRACT
This chapter sets out the following legislation together with relating checklists identifying the elements and other investigatory matters:
1 ss 79 and 80 of the Environmental Protection Act 1990 (breach of an abatement notice);
2 ss 2 and 3 of the Clean Air Act 1993 (dark smoke offences); 3 ss 2, 3 and 7 of the Health and Safety at Work etc Act 1974; 4 s 1 of the Protection of Animals Act 1911 (cruelty/neglect to animals); 5 Food Safety (General Food Hygiene) Regulations 1995; 6 Food Labelling Regulations 1996; 7 s 8 of the Food Safety Act 1990 (selling food not complying with food safety
requirements); 8 s 14 of the Food Safety Act 1990 (selling food not of the nature or substance or
quality demanded); 9 ss 376 and 198 of the Housing Act 1985 (repairs notices); 10 s 1 of the Protection from Eviction Act 1977 (unlawful eviction/harassment); 11 s 3 of the Dogs (Fouling of Land) Act 1996; 12 Refuse Disposal (Amenity) Act 1978 (penalty for unauthorised dumping); 13 s 33(1)(a) of the Environmental Protection Act 1990 (prohibition of unauthorised
