ABSTRACT
Most countries have created a legal structure in order to contain or control population movement. With any form of control the underlying philosophy for the reason of control must be analysed. It is at this juncture that the needs of the individual and society may need to be compared. In many countries control over movement on the basis of HIV status has been instituted and the justification of this must be questioned.
