ABSTRACT

This chapter explores the environmental effectiveness of emissions trading frameworks and the specific legal frameworks using the principles of Earth Jurisprudence as the theoretical framework. It includes the principles of Earth Jurisprudence and Wild Law is considered to develop criteria that will be used to analyze emissions trading schemes. The chapter explains the effects of emissions trading schemes will be examined to understand the legal impacts of economic and environmental measure. The emissions trading schemes of the European Union, New Zealand and Australia will be considered against the criteria enunciated in the chapter. The natural greenhouse effect of the Earth's climate system is amplified through anthropogenic greenhouse gases (GHG) emissions. When GHGs are emitted to a degree that the Earths ecosystem cannot adequately regulate them through natural processes, the consequence is a warming of the climate.
