ABSTRACT

In this chapter I will focus on three major areas of inequality in China today: (1) discriminatory legal statutes and regulations; (2) inequality in court judgments and enforcement of the law due to the disparity in power and status of the parties to disputes; and (3) inequality of access to justice and legal representation. Despite the valiant efforts of the Chinese government to create a ‘rule of law’ system and eradicate the worst excesses of the pre-modern and revolutionary past, the combination of these various kinds of inequality frequently leads to injustice for the weakest and most vulnerable members of society.
