ABSTRACT

The relationship of landlord and tenant arises from a lease, which is a grant of exclusive possession of land for a fixed period. Exclusive possession is the most important feature of a lease, as ‘The tenant armed with exclusive possession can keep out strangers and keep out the landlord’ (Street v. Mountford). Leases can be legal estates under s.1 of the Law of Property Act 1925, in which they are described as ‘terms of years absolute’.
