ABSTRACT

… the legal dimensions, including fundamental norms, of the required societal changes towards a climate-neutral society are examined systematically and presented from a normative-instrumental perspective. These legal aspects have essentially been ignored in much of the thinking about long-term climate policies. This has also been the case in the recent Netherlands’ Climate Change Policy Implementation Plans. The focus in this chapter is on relevant elements in the field of law: institutional responsibility, instruments and norms, enforcement, public participation and legal protection. Illustrations of each of these elements are also given. This chapter sets out the legal elements and conditions for the development of a successful Netherlands long term policy on climate change. These conditions should be integrated in the daily climate change policy of The Netherlands.
