ABSTRACT

So far, we have considered the circumstances in which a war as an enterprise might be considered just by examining the conditions of jus ad bellum. In this chapter, we will look at the jus in bello rules that govern the fighting of war. We will begin by looking at the way in which realists have tried to undermine the idea that there are moral rules that govern the fighting of war. We will then consider how just war theorists have traditionally conceived of the relationship between the justness of one’s war overall and the justness of how the war is fought. In the second part of the chapter, we will look specifically at the rules of jus in bello as they pertain to combatants, legitimate targets, legitimate tactics and prisoners of war.
