ABSTRACT

The first legislation of direct relevance to dementia care in Denmark was the Act on Social Service, passed in 1933. At that time, there was a focus on the care of frail elderly people in Denmark. According to the latest Act on Social Service, the municipal authorities or the county authority shall ascertain whether any relative or other person is in a position to safeguard the interests of the individual, and if not, the county authorities (the institution is called the state-county) should be requested to appoint a legal guardian under the Legal Guardianship Act §67, Act on Social Service 2002 (Consolidation Act on Social Services No. 755, www.sm.dk/english).
