ABSTRACT

During and after the feudal wars the individual was given a prominent position in a variety of local military codes and in the writings of the early authorities of international law, especially Alberigo Gentili and Hugo Grotius in the 17th century. The legal status of the individual as a protected object remains the same in the Statute as it exists in International Humanitarian Law where he is accorded the passive role of being a recipient of the protection of his rights. His rights as a protected person in the Statute are found in the Articles defining the crimes within the jurisdiction of the Court under Part 2. According to the Statute, if the Prosecutor concludes that there is a reasonable basis to proceed with an investigation based upon the information provided by an individual, he shall obtain the authorization of the Pre-Trial Chamber.
