ABSTRACT

In any assessment of the future prospects of the Court, an important factor to be taken into account will be the strength of the Court's relationship with the United Nations, including the Security Council. The relationship of the Security Council with the future Court is an interesting one. It was not surprising that the question of the link between the two bodies arose early in the negotiations of the Court: the functions of both bodies relate in their different ways to international peace and security. The major role for the Security Council envisaged in the Statute - the referral of situations to the Court - was not a matter of great controversy at the Conference. There were objections to it, but they were largely politically motivated. Concerns expressed by some previous speakers about Article 16 were indeed the subject of discussion at the Conference.
