ABSTRACT

The impacts of climate change are recognised by major human rights stakeholders. The United Nations Framework Convention on Climate Change (UNFCCC) Adaptation Committee is the key institution mandated to promote coherence on adaptation under the Convention. The basic linkage between human rights and climate change is the same for loss and damage as for adaptation: Climate change impacts already adversely effect, and will do so even more key areas which are fundamental to fulfilling human rights. The principal human rights obligations in relation to climate change impacts are well established, and also have to be seen in conjunction with obligations under the UNFCCC, including the Paris Agreement which is into force. Various statements and publications have strengthened the underpinnings of the human rights and climate change impacts link, including the International Bar Association and Mary Robinson Foundation. The Human Right to Water and Sanitation was recognised by the United Nations General Assembly on 28 July 2010.
