ABSTRACT
Western civil tradition assumes that adults have the capacity to make their own decisions. In specic instances courts are asked to intercede and abridge these rights. e courts are entrusted to protect a person from his or her own inability to make rational decisions, or to protect others from the same. Forensic psychiatrists, in turn, are oen asked to provide an evaluation and opinion on whether and how mental illness impacts a person’s ability to make decisions.
