ABSTRACT

The judicial system of China comprises subsystems for investigation, prosecution, trial procedures, jails, judicial administration, arbitration, lawyers, public notaries, and state compensation (China Internet Information Center, n.d.). In conducting criminal proceedings, the public security agencies, the People’s Procuratorates, and the People’s Courts perform their task independently; however, cooperation between these three divisions may be necessary for some cases. The public security agencies are responsible for investigation, detention, execution of arrests, and preliminary inquiry in criminal cases. The People’s Procuratorates are responsible for procuratorial work, authorizing approval of arrests, conducting investigation, and initiating public prosecution of cases directly accepted by the procuratorial agencies. adjudication. The People’s Courts and the People’s Procuratorates are elected, report to, and are supervised by the People’s Congress at various levels. The People’s Courts, the People’s Procuratorates, and the public security agencies divide responsibilities, coordinate their efforts, and check each other to ensure correct and effective enforcement of law.
