Native American Graves Protection and Repatriation Act The year 2008 saw litigation and regulatory and legislative activity concerning the Native American Graves Protection and Repatriation Act (NAGPRA).1 NAGPRA is a federal law that recognizes cultural property rights of individual Indians, Indian tribes, and Native Hawaiian organizations and enables these groups to make claims to seek the return of ancestors and items of cultural property. NAGPRA provides the opportunity for the return of human remains and artifacts; ultimately, those with standing to make the claims determine what action to take.
